Opt-Out

If you are an Equity Trust Company customer with a Traditional, Roth or SEP IRA, you may opt out of the Arbitration Agreement in Article 18 of your Custodial Account Agreement by completing the information below and clicking the “Submit Opt-Out Request” button at the bottom of this page. The decision whether to opt out of the Arbitration Agreement is entirely yours and will not affect your ongoing relationship with Equity Trust Company or the services it provides. Please review Article 18 of your Custodial Account Agreement for additional details.

IF YOU OPENED AN IRA ACCOUNT ON OR AFTER JANUARY 1, 2019, AND YOU WISH TO OPT OUT OF THE ARBITRATION AGREEMENT, YOU MUST OPT OUT WITHIN 65 DAYS OF OPENING THE IRA ACCOUNT. IF YOU DO NOT WISH TO OPT OUT OF THE ARBITRATION AGREEMENT, YOU DO NOT NEED TO TAKE ANY ACTION.

PLEASE NOTE THAT FOR ANY IRA ACCOUNT OPENED BEFORE JANUARY 1, 2019, THE OPT OUT PERIOD CLOSED ON MARCH 31, 2019, AND YOU CAN NO LONGER OPT OUT OF THE ARBITRATION AGREEMENT FOR THOSE ACCOUNTS.

If you have more than one Traditional, Roth or SEP account at Equity Trust Company, and you submit an opt-out request for any of your accounts, your other open accounts will be included in your request to opt out of the Arbitration Agreement.

If you timely opt out of the arbitration agreement, you will still be bound by the other terms in your Custodial Account Agreement. If you do not timely opt out of the Arbitration Agreement, you will be deemed to have agreed to the Arbitration Agreement and be bound by it.
